SB 71 affects psychiatric hospitals, psychiatric residential treatment facilities in Nevada Effective immediately, all state-licensed psychiatric hospitals that provide inpatient services to children must conduct background checks on employees, employees of temporary employment service agencies working at the facility, and independent contractors, in accordance with Nevada Revised Statutes (NRS) and Nevada Administrative Code (NAC) 449. Previously, only psychiatric hospitals that provided residential services to children had to conduct these background checks, but this requirement has been expanded to include inpatient services to children with the passage of Senate Bill 71 during the 2017 session of the Nevada Legislature. Psychiatric residential treatment facilities (PRTF) were also added as a facility type that must conduct background checks in accordance with NRS and NAC Chapter 449.
All facilities impacted by this memo must use the Nevada Automated Background Check System (NABS) to conduct the background checks. Instructions for Getting Set Up to Conduct Background Checks in Accordance with NRS Chapter 449

When hiring a new employee, you enter them into NABS (Nevada Automated Background System) by going to “Applications – Add New.” If the applicant comes up as “Eligible for Employment,” you may hire the person without sending them to be fingerprinted again, thereby avoiding fingerprint processing fees. TO DO THIS YOU MUST FOLLOW THE INSTRUCTIONS BELOW:
FAILURE TO DO THIS WILL REQUIRE NEW FINGERPRINTS BECAUSE IF YOU PICK THE SECOND CHOICE YOU ARE TELLING THE SYSTEM YOU ARE SENDING THE INDIVIDUAL TO BE FINGERPRINTED AND PAYING FOR NEW FINGERPRINTS. We cannot undo this choice. This is your choice, choose correctly to avoid problems and additional costs. NOTE: To more easily identify these buttons, the titles have been changed. The first option used to say, “Recheck Registries (fingerprints not required).” It has changed to: “Fingerprints NOT required (choose this one if you don’t want to do fingerprints).” The second option used to say, “Add Application (fingerprints required).” It has changed to: “Fingerprints Required – Pay for new fingerprints/add application (choose this one to do fingerprints again)” Note: Information is for training purposes only.
